What is the Van der Elst Visa?
The Van der Elst Visa allows companies legally established in an EU country (e.g., Poland) to post their non-EU employees to another EU Member State (e.g., Germany or Belgium) for short-term work on a specific contract.
Where to apply in Germany
- Applications are filed in person at the Consular Section of the German Embassy in Warsaw. Forms can be obtained at the embassy or downloaded from the official website and must be completed in German.

General rules
Business postings are time-limited. If your contract lasts longer than the visa, a new application may be required.
Required documents
- Copy of the employee’s contract with the employer in Poland;
- Valid passport (recommended validity at least 6 months from application date);
- Service contract between the Polish employer and the client in Germany/Belgium;
- Employer’s letter describing purpose, duration of posting, and services to be rendered;
- Employee’s medical insurance covering the posting period;
- Valid work authorisation in the EU country where the employer is established (valid through the requested period);
- Proof of consular fee payment;
- Two biometric photos 35×45 mm.
