Refusal, discontinuation, refusal to initiate — the differences
Not every negative letter from the office is a “refusal”. The type of decision determines which remedy you have and how much time. Always read the pouczenie (instructions on remedies) at the end — it names the remedy, the deadline and the authority.
| Decision | Typical cause | Remedy | Deadline |
|---|---|---|---|
| Decision refusing the permit | conditions not met or a ground for refusal | appeal to the Head of UdSC | 14 days |
| Discontinuation (umorzenie) | e.g. not attending for fingerprints, not showing the passport (art. 106i) | as stated in the pouczenie | as stated |
| Order refusing to initiate proceedings | e.g. staying on a visa that excludes a single permit | zażalenie to the Head of UdSC | 7 days |
| Application left unexamined | formal defects not fixed | ponaglenie to the Head of UdSC (per office instructions) | — |
| No decision on time | delay by the office | ponaglenie, then WSA complaint | practically unavailable until 4 March 2027 |
Most common grounds for refusal
- not meeting the conditions of the ground (e.g. missing required income or insurance, work not matching the attachment);
- an entry in the register of foreigners whose stay is undesirable, or an SIS entry;
- defence, security or public-order reasons;
- unpaid fees;
- false data or documents.
From 1 June 2025 the grounds for refusing to initiate single-permit (residence and work) proceedings were widened. They cover, among others, people who on the filing date are in Poland on certain Polish visas, a tourist or visiting Schengen visa of another country, another Schengen state’s residence document (unless using mobility) or an entry permit.
What to do after a refusal — step by step
- Establish the delivery date. The decision arrives by post or e-Doręczenia, not via MOS. Count 14 days from delivery (7 for a zażalenie). Note the date and keep the envelope or the e-Doręczenia confirmation.
- Read the reasoning. List each reason for refusal separately. Each one needs an answer: an argument, a document or an explanation.
- Check your status. If you filed on time and the application was formally complete, your stay is legal until the decision becomes final — including during the appeal.
- Gather evidence. You may submit new documents with the appeal; the second-instance authority re-examines the case. What usually proves the conditions of each ground is covered on residence card documents.
- Write the appeal. The law does not require detailed reasoning — it is enough to state that you disagree with the decision. In practice, addressing each reason and adding new evidence improves your chances considerably.
- File it the right way. The appeal is addressed to the Head of UdSC but lodged through the voivode who issued the decision — on paper (in person or by post) or via e-Doręczenia. MOS does not accept appeals.
- Watch your post. The appeal stage has a statutory 90 days, but until 4 March 2027 that limit does not run. Requests for additional documents may arrive meanwhile.
Appeal to the Head of UdSC
The Head of the Office for Foreigners is the higher authority above the voivode in foreigners’ cases. You can appeal decisions on temporary residence, its withdrawal, visa extension and issuing or replacing a residence card, as well as permanent residence and EU long-term resident status.
A good appeal identifies the decision (number, date), gives your details and case number, states clearly that you are appealing, answers each reason for refusal and lists the attached evidence with sworn translations. You sign it by hand (paper) or electronically (e-Doręczenia). If the refusal was caused by gaps you can now fill, attach the missing documents straight away.
If you missed the deadline through no fault of your own (for example illness), you can ask for it to be restored: the request is filed within 7 days of the obstacle ending, together with the appeal itself, and you must show it was not your fault.
Zażalenie against refusal to initiate proceedings
If the voivode does not open proceedings at all, it issues an order (postanowienie), not a decision. The remedy is a zażalenie within 7 days of delivery, also to the Head of UdSC via the voivode. It is a short deadline — every day counts.
Since 2025 the most common case is a residence-and-work application filed while staying on a visa for which the law excludes initiating proceedings. A zażalenie makes sense if the office misjudged your basis of stay (for example the visa type or your use of mobility). If the assessment was correct, planning a different legalisation route is usually wiser.
Ponaglenie when a case drags on
A ponaglenie is a complaint about inactivity or excessive delay, sent to the Head of UdSC via the voivode. Until 4 March 2027 the rules on inactivity and delay do not apply in residence cases (art. 100d), so a ponaglenie based only on delay is practically ineffective. The Silesian office says that until then acceleration can be requested only in exceptional situations, such as humanitarian ones, and with evidence. More on deadlines: residence card processing time.
Complaint to the regional administrative court (WSA)
If the Head of UdSC upholds the refusal, the decision is final. You can challenge it before the regional administrative court — for decisions of the Head of UdSC this is the WSA in Warsaw. The complaint is filed within 30 days of delivery of the decision, through the Head of UdSC; the pouczenie states the deadline and method. The court reviews whether the decision is lawful rather than re-deciding the case like the office. A court fee (wpis) is charged.
A court complaint about the authority’s inactivity is practically unavailable until 4 March 2027 for the same reasons as the ponaglenie — the Silesian office cites a ruling of the WSA in Gliwice (III SAB/Gl 231/23).
Stamp duty after a refusal or discontinuation
The Act of 23 January 2026 (Dz.U. 2026 item 203) changed the rules: for applications filed from 5 March 2026, stamp duty is not refunded if the voivode refuses the permit or discontinues the case. This covers temporary residence, permanent residence, EU long-term resident status, amendment of a single permit and visa extension. A new application therefore means a new fee — 340 to 640 zł depending on the permit, plus 100 zł for the card.
Appeal or a new application?
| Appeal | New application | |
|---|---|---|
| When it makes sense | the office misjudged the evidence, or missing documents can be supplied | circumstances have changed (new employer, different ground) |
| Legal stay | continues until the final decision if you filed on time | you must be staying legally on the filing date |
| Official cost | no new stamp duty | new stamp duty and card fee |
| Risk | if the reason for refusal is permanent, an appeal only delays the end | without removing the cause, the refusal may be repeated |
Once the decision becomes final, the art. 108 basis for legal stay ends. If you have no other basis (a visa, visa-free stay), check the pouczenie for the obligations that follow and do not leave the situation unaddressed. A new application is filed in MOS — see our step-by-step MOS application guide.

Frequently asked questions
Can I stay in Poland legally while my appeal is pending?
Yes, if your original application was filed no later than the last day of your legal stay and was formally complete. Your stay is legal until the decision becomes final, which includes the appeal stage.
Is the appeal filed through MOS?
No. Appeals and zażalenia are filed on paper or via e-Doręczenia, to the Head of UdSC through the voivode who issued the decision.
When do the 14 days start?
On the day the decision is delivered — when you receive the letter or it is delivered via e-Doręczenia. Keep the envelope or confirmation, as the date may be disputed.
Will I get my stamp duty back after a refusal?
Not if the application was filed on or after 5 March 2026. In that case the fee is not refunded on refusal or on discontinuation.
I missed the appeal deadline — what now?
If it was not your fault, you can ask for the deadline to be restored within 7 days of the obstacle ending, filing the appeal at the same time. Otherwise the usual option is a new application, provided your stay is still legal.
Does MaViAl guarantee a successful appeal?
No. Nobody can honestly guarantee that. We tell you your real chances and prepare the strongest possible case.
